Terms and conditions

These terms and conditions apply unless:

• The Supplier and Purchaser (or the relevant group company of the Purchaser) have entered into an executed agreement governing the supply of the goods and/or services (“Executed Agreement”), in which case the terms and conditions of the Executed Agreement shall apply; or
• There is no existing Executed Agreement between the Supplier and the Purchaser, but the Purchaser has sent the Supplier an Optus Simple Supply Agreement (“Forwarded Simple Supply Agreement”), in which case the terms and conditions of the Forwarded Simple Supply Agreement shall apply.

Acceptance

In the absence of an Executed Agreement or Forwarded Simple Supply Agreement, the Supplier agrees that by commencing delivery of the goods and/or services which are the subject of this Purchase Order, it shall be deemed to have accepted the following terms and conditions:

From 12 May 2017 to 16 May 2022: Simple Supply Agreement Terms and Conditions

From 17 May 2022 to 31 October 2023: Simple Supply Agreement Terms and Conditions
